PRIVACY POLICY

This privacy policy ("PRIVACY POLICY") applies to use of the Paysharp websites and the services provided by Paysharp.

Definitions

"Payment Aggregators" or "PAs" means as respectively ascribed thereto under the PA & PG RBI Circular.

Paysharp Private Limited ("Paysharp") a regulated entity provides Payment aggregator / Payment gateway services

"Applicable Laws" means Information Technology Act 2000, Payment and Settlement Systems Act 2007, Guidelines on Regulation of Payment Aggregators and Payment Gateways 2020, Prevention of Money Laundering Act, 2002, The Digital Personal Data Protection Act, 2023, RBI KYC guidelines and any other applicable rules and regulations issued there under whichever laws applicable in India.

"Password" means a secret phrase or code used along with user Id, that used to gain login or access to information.

"Industry standard security best practices" means security best practices and procedures designed to protect Personal Data from unauthorized access, damage, misuse, modification, disclosure or impairment, as may be specified in an agreement between the parties or as may be specified under Applicable Laws.

"Merchants" means the establishments who accept payments from their customers by sale of goods or services to the customers who obtaining PA & PG services offered by the Paysharp.

"Customer" means a person (End-customer) who executed a transaction by using a Payment Instrument / mode / channel for the merchant's transaction.

"Visitors" means a person who visits Paysharp websites either who submit any information to Paysharp or only visit.

"Personal Data" means any information that relates to Merchant or Customer, which, either directly or indirectly, in combination with other information available or likely to be available with Paysharp is capable of identifying merchant or customer, It might be mobile number, UPI VPA, Bank account information, KYC details, etc…

"Processing" in relation to Personal Data means an automated operation or set of operations performed on Personal Data, and may include operations such as collection, recording, organising, structuring, storing, altering, retrieval, use, sharing, disclosure by transmission, dissemination or otherwise making available, restriction, decommissioning.

"Exception to Personal Data" means If any information provided by Merchant / Customer is openly/freely available or accessible in public domain or furnished under the Right to Information Act, 2005 or any other Applicable Laws, such information shall not be regarded as Personal Data.

"Cookie" mean a small text file of combination of alpha numeric and symbols that is stored by the browser on user's device when customer / merchant / visitor visits Paysharp websites or Paysharp URLs.

"Users" mean combined used for Merchants, Customer and Visitors.

Scope of this Privacy Policy

Paysharp takes privacy and data protection seriously. We have developed the Privacy Policy to explain how Paysharp handles personal data collected from Users (Merchants, Customer and visitors)

This Privacy Policy covers Paysharp's treatment of personal information collected from Users who use the Paysharp PA/PG services, as well as customer information that we acquire in the course of our transaction processing and visitors who visits Paysharp websites. This Policy also covers the treatment of personal data that Paysharp's back-end technology providers / acquiring bank may share with it.

This Policy applies all Paysharp services.

FOR MERCHANTS

Paysharp respects merchant's privacy and wants to promote trust and confidence. The policy disclose what information Paysharp collects and how it processed.

Information security is critical to Paysharp's business. We work to protect the security of information during transmission and storage. We always using encryption while transmitting and storing. We use advanced security technology to prevent our system from being accessed by unauthorized access. It is important for Merchant to protect against unauthorized access to the Login ID/password and API keys.

Currently, Paysharp collects personal information from Merchants during onboarding also after onboarding as per RBI guidelines and applicable laws, the service agreement that they execute and various submitted documents of the Merchant's creditability as required by Paysharp from time to time.

Paysharp uses cookies in websites and applicable Paysharp URLs to for security and analytical purpose Website uses third-party analytics to track website visitors like referring site, the time that user spend on the Paysharp website, etc… . also, who visits an Paysharp URLs IP address, User agent(browser) information and other related information collected.

The information collected from merchant like personal information - Name, E-mail address, Contact No. which helps us to inform you about updates, or changes to the service and to notify you of products and services of Paysharp. While onboarding and in regular interval Paysharp will do background verification based on the merchant information.

Paysharp uses Industry standard security best practices to keep and use the personal information and will not disclose this information to other individuals or organizations unless required by law. Paysharp will not distribute merchant / customer information to be used in advertisement networks, mailing lists, surveys, or any other purpose other than what is required to perform our services. However, Paysharp will send partial personal data to other companies or people when:

  • Personal data shared with third parties (such as our Acquiring banks and Financial Intrusions like NPCI) to the extent necessary for Paysharp to deliver payment processing services.
  • In case if we have your consent to share the information;
  • We need to share the information to provide the product or service you have requested;
  • We need to share to the Law enforcement agencies if required or if we identify suspicious transactions

Paysharp is committed to safeguarding the privacy of our personal data. Paysharp may also have hyper links to other websites like social media, news websites, etc.. . We are not responsible for their privacy policies or how they treat information about their users.

FOR CUSTOMERS

Paysharp takes privacy and data protection seriously. We have developed the Privacy Policy to explain how Paysharp handles personal data collected from Merchants.

As a customer might transact through Paysharp without knowing they are using Paysharp's service while making payment to merchant.

Paysharp being a responsible organisation acknowledge the Importance of right to privacy. Paysharp values that trust. And we are committed to protect and safeguard customer personal data.

This Policy also covers the treatment of personal information that Paysharp back-end technology providers/partners may share with it. This document describes the usage of the personal data acquired by Paysharp.

This Policy sets out how we will use and protect your information. We will use your personal information only for the purposes and in the manner allowed by the applicable data protection laws. We recommend that you read this Privacy Policy carefully.

Please be aware that Paysharp does not warrant the acts of its Merchants, All customers and visitors should be aware that, when they disclose personal information such as their actual name, e-mail address, contact number etc. to third parties, the information may be collected and used by others to send that person unsolicited e-mail /SMS from other parties, outside of Paysharp. In the event that you encounter any Merchant who is improperly collecting or using information about customers, in this situation Paysharp does not have much control on that. please contact us by emailing at complaints@paysharp.in so we could investigate the merchant and take necessary action.

FOR VISITORS

Visitor means a person or individual who visits Paysharp websites either who submit any information to Paysharp or only visit.

The cookies that we use are essential for the basic functionalities of the service. Paysharp does not use cookies to spy on visitors or otherwise invade your privacy. Also, Paysharp does not use cookies for any third-party advertisement purpose.

For analytics, Paysharp uses third-party analytical services and cookies are used for this purpose by those services. This may be for identifying and distinguishing the visitors and traffic information.

COLLECTION AND HANDLING OF PERSONAL DATA

Personal Data collected by Paysharp

Paysharp asks customers to provide various personal data when placing an online order, such as name, e-mail, contact number, UPI VPA. and other details based on payment option customer choose. (as per the rules and regulation law, established by the RBI, Banks and Financial Instructions). In addition to fraud prevention, we also collect IP address, User agent(browser) information, etc…. There are also situations in which we receive information about users from others sources Example

  • Customer - While customer transact using Paysharp.
  • Merchant - During merchant background verification.
  • Visitor – From analytics tools.

We may also receive information about customer from other sources. These include acquiring bank, financial institution and other independent third parties, and anything we get from them may be combined with information provided by customer.

Reason for collecting and Processing the Data

We collect the personal information to render our services efficiently, avoid fraudulent transaction and suspicious transaction monitoring. To do that Paysharp required to have the personal information of the customer to authorise and complete the transactions or requests of the Customers. Paysharp collect and process the information mainly for the following purposes:

  • To help you complete the transaction that you have requested and to process any payment.
  • To contact you if required in relation to the transaction.
  • For security and fraud prevention purposes

Sharing of Data

Paysharp currently share the personal data, where necessary, with the following recipients:

  • To the merchant and customer who involved in the transaction
  • Acquiring Banks, Financial Intuition and regulator
  • Law enforcement agency
  • Third party service providers to delivery Services (email delivery, SMS, etc…)

Personal Data Security

Paysharp is a regulated entity and our operation are monitored by the RBI, Acquiring Bank. Paysharp also have the certification of ISO 27001 and SOC 2. Paysharp protects, processes and uses all the data collected in accordance with the applicable Data Protection Laws.

Paysharp uses industry standard security best practices to prevent unauthorized access to, and the misuse of, personal data collected by Paysharp. Paysharp uses access various controls and encryption to safeguard the personal data.

We use appropriate business systems and procedures to protect and safeguard the personal data collected by us. We also use security procedures and technical and physical restrictions for accessing and using the personal data on our servers. Only authorized Paysharp employee are permitted to access personal data in the course of their work.

We will retain your personal data for as long as required by applicable laws. All personal data we retain will be subject to this Privacy Policy. Control of Data

Merchant / Customer has all the right and control over their personal data provided to Paysharp. Customer can request us for an overview of their data by putting up an e-mail to us.

We rely on Customer / Merchant to ensure that your personal data is complete, accurate and and up-to date. Please do inform Paysharp promptly of any changes to or inaccuracies of to personal data by reaching us.

  • Paysharp want merchant/customers to be in control of how personal data is used by us.
  • Request a copy of the personal data we hold about that particular individual
  • Inform us of any changes to their personal data, or can ask Paysharp to correct any of the personal data hold by Paysharp

Personal Data of Children

Paysharp services are only allowed to be use by adults over 18 years of age. During merchant onboarding Paysharp collects age proofs does not onboard merchants below 18 years. Paysharp does not collect age from customers so Paysharp does not know the age of the customer or does not have to option to identify the age of the customer. Paysharp declares Paysharp services should only be used by eligible adults.

Cookies

A cookie allows a website to distinguish devices from other users' devices. Cookies do not contain personal data. You may delete or block the cookies, if that is what you choose to do. Cookies used for identification, authentication, authorisation and analytical purposes.

DISCLAIMER

We respond to subpoenas, warrants, or other court orders regarding information that is contained within our access logs concerning any Merchant, customer or visitor. We reserve the right to release that information concerning any Merchant who we believe is in violation of our content guidelines, even without a subpoena, warrant, or other court order. We cooperate with law enforcement agencies in identifying those who use our services for illegal activities.
